# Notice of Privacy Practices

Her Mind & Wellness, PLLC · Effective 2026-10-11

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Her Mind & Wellness, PLLC (“the Practice,” “we,” “our”) provides adult psychiatric health care, including in-person services in El Paso and telehealth in Texas. This Notice of Privacy Practices (“Notice”) describes the ways we may use and disclose protected health information (“PHI”) and the rights you have regarding that information. It applies to PHI created or maintained by the Practice. Independent health plans, referral partners, and scheduling or payment platforms may provide separate notices for their own activities.

## Your Rights

Access your record. You may request to inspect or receive an electronic or paper copy of your medical record and other PHI about you, subject to lawful exceptions. Under Texas Health and Safety Code §611.008, qualifying written requests to examine or copy recorded mental-health care information must generally be addressed no later than the 15th day after receipt, by providing access/copies or informing you the information does not exist or cannot be found. For records governed by HIPAA's general access rule, we ordinarily respond within 30 days, subject to applicable extensions. Fees, if any, will be limited to those permitted by law. In some narrowly defined circumstances, access may be denied or limited, with the notices and review rights required by law.

Request correction. You may ask us to amend PHI you believe is inaccurate or incomplete. If we deny the request, we will explain the reason in writing, generally within 60 days, subject to extensions permitted by law.

Request private communications. You may request that we contact you by a particular reasonable method or at a different address. We will accommodate reasonable requests.

Request restrictions. You may ask us to restrict certain uses or disclosures for treatment, payment, or health care operations. We may not be required to agree except where the law requires it. If you pay in full out of pocket for a service, you may request that we not disclose information about that service to a health plan for payment or health care operations; we will honor the restriction unless disclosure is required by law.

Request an accounting. You may request a list of certain disclosures of your PHI made during the six years preceding your request. Disclosures for treatment, payment, health care operations, and certain other categories are generally excluded. One qualifying accounting in a 12-month period is free; later requests may involve a lawful cost-based fee.

Get a copy of this Notice. You may request a paper copy even if you agreed to electronic delivery.

Choose a representative. A person with appropriate legal authority, such as a valid health care agent or guardian, may exercise your privacy rights. We will verify the authority as required.

Complain without retaliation. You may complain to our Privacy Contact below or to the U.S. Department of Health and Human Services Office for Civil Rights at [https://www.hhs.gov/hipaa/filing-a-complaint/index.html](https://www.hhs.gov/hipaa/filing-a-complaint/index.html) You will not be retaliated against for making a complaint.

## Your Choices and Authorizations

You may tell us whether and how to share relevant information with family, friends, or others involved in your care or payment for care, and in disaster-relief situations. We will follow applicable law and your stated preferences. When you cannot express a preference, disclosures may be permitted when legally authorized and in your best interest or necessary to reduce a serious and imminent threat.

Except where law provides otherwise, we obtain your written authorization for uses or disclosures requiring it, including most disclosures of separately maintained psychotherapy notes, uses for marketing that require authorization, and sales of PHI. You may revoke an authorization in writing, although that will not undo disclosures already made in reliance on it.

The Practice does not operate a hospital patient directory. If we engage in fundraising involving patient information, we will provide any notices and opt-out opportunities the law requires; additional protections apply to substance-use-disorder records.

## How We May Use and Disclose PHI

Treatment. We may use your PHI and share relevant information with professionals participating in your care, such as other treating clinicians, pharmacies, or laboratories, when permitted by federal and Texas law.

Payment. We may use or disclose appropriate PHI to bill and collect payment, including eligible insurance claims and services involving health plans or payment partners, subject to legally required restrictions.

Health care operations. We may use and share necessary PHI for practice administration, patient communication, quality improvement, compliance, auditing, and lawful business operations. Service providers handling PHI for us must comply with the protections required for their role, including business-associate agreements where applicable.

Other legally permitted or required purposes. Subject to applicable limits and prerequisites, we may use or disclose PHI for public health reporting, suspected abuse or neglect reports, serious threats to health or safety, health oversight, required government functions, lawful research, medical examiners or funeral directors, and court, administrative, or law-enforcement proceedings. We disclose information when law requires us to do so, including to HHS for compliance investigations. A subpoena or other request does not automatically override legal confidentiality requirements.

## Additional Mental-Health and Substance-Use-Disorder Protections

Texas mental-health confidentiality. Texas Health and Safety Code Chapter 611 protects confidential communications and records relating to the identity, diagnosis, evaluation, or treatment of a mental or emotional condition. We will not disclose these records except with appropriate authorization or as allowed or required by applicable state and federal law. Certain mental-health records have additional access and review protections under Texas law.

Psychotherapy notes. Notes that meet HIPAA's special definition of “psychotherapy notes” receive additional protections. Most uses and disclosures of those notes require separate written authorization unless a specific legal exception applies. Routine psychiatric progress notes are not automatically psychotherapy notes under that definition.

42 CFR Part 2 records. If we create, receive, or maintain substance-use-disorder patient records protected by 42 CFR Part 2, additional confidentiality rules apply. In particular, such records generally may not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against you without your written consent or the court order and subpoena or other legal process required by Part 2. We will observe any additional Part 2 restrictions, notices, and patient choices that apply.

Where federal and state privacy laws impose different requirements, we will follow the requirements applicable to the particular record and disclosure, including more protective state-law rules where legally controlling.

## Our Responsibilities

We are required by law to protect the privacy and security of your PHI; provide this Notice and follow the privacy practices described in the notice currently in effect; and notify you of a breach of unsecured PHI when notification is required by law. We will not use or disclose PHI beyond what this Notice and the law allow without obtaining your written authorization where required.

We may change this Notice and apply revised terms to the PHI we maintain, as permitted by law. The latest approved version will be available on our website, in our office, and on request. Changes will be identified by a new effective date.
